A partir dessa lei geral, cada Estado institui o tributo por alíquota, a qual é regulamentada através de Decreto, o chamado "regulamento do ICMS" ou "RICMS", que é uma consolidação de toda a legislação sobre o ICMS vigente no Estado, e é aprovada por Decreto do Governador.
